1. Definitions
"Company," "We," "Us," or "L'Atitude 52°N" shall mean the business entity of L'Atitude 52°N or its affiliates responsible for the sale of Products and provision of official after-sales services. The specific contracting entity shall be determined by the checkout page, order confirmation email, invoice, or payment record.
"Product(s)" refers to L'Atitude 52°N branded AI glasses, hardware, accessories, bundles, and other items explicitly marked for official sale, excluding software subscriptions, third-party services, digital content, or third-party branded goods governed by independent terms.
"AI Glasses" refers to smart wearable eyewear integrated with cameras, audio, Bluetooth connectivity, voice interaction, AI vision, translation, AI voice assistants, or other software-driven functionalities.
"Consumables" shall mean components or materials subject to natural depletion, wear and tear, or expiration through normal use, including but not limited to: (i) lenses and coatings; (ii) batteries and their charging capacity; (iii) nose pads and ear sleeves; (iv) frames, decorative elements, and surface finishes; and (v) cables and cleaning accessories.
"Normal Wear and Tear" refers to the natural deterioration, aging, or performance attenuation arising from reasonable and ordinary use, including minor scratches, coating abrasion, slight discoloration, or battery capacity decay that does not impair the Product's core functionality.
"Core Functional Failure" refers to malfunctions occurring under normal usage conditions, verified by the Company to originate from materials, manufacturing, or assembly defects, which substantially impede the Product's primary operations.
2. Scope and Acceptance of Terms
By placing an order, completing payment, accepting delivery, or activating the Product, you acknowledge that you have read, understood, and agree to be legally bound by this Policy. You represent and warrant that:
You possess the legal capacity to enter into a binding contract;
All information provided (identity, delivery, and payment) is true, accurate, and complete;
Your use of the Product shall comply with all applicable laws, including but not limited to regulations governing audio/video recording, privacy, data protection, and export controls.
3. Order Submission and Formation of Contract
Order Acknowledgment: Submission of an order constitutes an offer to purchase. Any automated acknowledgment received thereafter indicates receipt of your request but does not constitute final acceptance of the order.
Contract Formation: A binding contract is formed only when the Company issues a formal shipping confirmation or effectively delivers the Product to a carrier for shipment.
Right of Refusal: Prior to acceptance, the Company reserves the unilateral right to refuse, limit, or cancel any order due to: (i) stock unavailability; (ii) manifest errors in pricing or descriptions; (iii) suspected fraud or unauthorized payment; or (iv) violation of anti-resale policies.
4. Pricing, Taxation, and Payment
Costs: Prices, shipping fees, and applicable taxes are as displayed at the time of checkout. The Company reserves the right to adjust prices at its discretion; however, such adjustments shall not affect orders already accepted by the Company.
Payment Authorization: You authorize the Company and its third-party payment processors to charge your selected payment method for the total order amount. Failure of payment authorization may result in immediate order cancellation.
International transaction fees (also called foreign transaction fees) may be charged to customers by your own bank or credit card issuer — even when you're charged in your local currency. These fees are not controlled by Shopify and vary by bank. Customers would need to check with their bank about these.
5. Delivery, Risk of Loss, and Title
Territory: Delivery is currently restricted to designated regions within the European Union, the United Kingdom, and the United States.
Estimated Timelines: Any provided delivery dates or windows are good-faith estimates only and do not constitute a guarantee of delivery by a specific date. The Company shall not be liable for delays caused by Force Majeure events, including but not limited to customs clearance, strikes, or supply chain disruptions.
Transfer of Risk: Risk of loss and damage to the Product passes to you upon delivery of the Product to the carrier or the designated delivery address.
Failed Delivery: If delivery fails due to your provision of inaccurate information, refusal of receipt, or failure to comply with customs requirements, you shall be liable for all resulting costs, including return freight and storage fees.
6. Pre-orders and Extended Lead Times
For Products designated as pre-orders or batch-produced items, the Company provides estimated shipping windows. These timelines are subject to adjustment based on production and regulatory compliance requirements. In the event of a material delay, the Company may, at its discretion, provide reasonable alternatives or a full refund.
7. Cancellation Policy
Pre-shipment: You may request cancellation prior to shipment; however, approval is subject to the current processing stage of the order.
Post-shipment: Once a Product has been dispatched, the order may not be canceled. You must instead follow the procedures set forth in the Company's Return and Refund Policy upon receipt of the Product.
